These terms establish the legal framework for accessing and using our commercial property management services.
These terms of use ("Terms") govern access to and use of the Kirkwoodcourt portal, including all associated modules and functionalities, by any natural or legal person ("User").
The portal provides digital tools for managing corporate lease contracts, auditing the energy efficiency of office buildings, and planning preventive maintenance budgets. Accessing or using the portal implies unconditional acceptance of these Terms.
The User undertakes to provide accurate and complete information when registering an account and to update any changes within 5 working days.
The energy audit and budget planning modules are provided exclusively for informational and decision-support purposes. The generated results do not constitute binding financial or legal advice.
Kirkwoodcourt makes reasonable efforts to ensure the proper functioning and availability of the portal but does not guarantee uninterrupted access or the absence of technical errors.
To the maximum extent permitted by law, Kirkwoodcourt is not liable for indirect losses, moral damages, or loss of profits resulting from the use or inability to use the portal.
Any complaint regarding the malfunctioning of services must be submitted in writing to the email address info@kirkwoodcourt.com within 7 days of the incident occurring.
All materials, including text, interface, logos, databases, and specific algorithms of the leasing and energy audit modules, are the exclusive property of Kirkwoodcourt or its licensors.
The User acquires no intellectual property rights over the portal's content, except for the limited right to use the services in accordance with these Terms.
The processing of personal data is carried out in accordance with the Privacy Policy available on the portal. Kirkwoodcourt implements appropriate technical and organizational measures for data security.
The User is informed that lease contract data and energy audit reports may be stored on servers located in the European Economic Area. Access to this data is limited to authorized Kirkwoodcourt personnel.
Kirkwoodcourt reserves the right to modify these Terms at any time, with prior notice to Users via the portal or email, at least 14 days before the changes take effect.
Continued use of the portal after the effective date of the changes constitutes acceptance thereof. In case of disagreement, the User may request account termination within 30 days.
Kirkwoodcourt may suspend or terminate the User's access to the portal, without prior notice, in the event of a serious breach of these Terms, including but not limited to providing false information or abusive use of the modules.
Upon termination, the User is obliged to immediately cease using the portal and delete any copies of downloaded content. Kirkwoodcourt will return the User's personal data within 30 days of the request, except in cases where the law requires their retention.
These Terms are governed by Romanian law. Any dispute that cannot be resolved amicably will be settled by the competent courts of Iași municipality.
